Legislative Session

Sen. Roach

This bill states that the aggravated circumstances that may be considered by the court in its decision to terminate parental rights without making reasonable efforts to unify the family will include circumstances in which the parent is a named suspect in an active murder investigation. The court will review all available evidence from law enforcement to determine whether reunification would be detrimental to the health, safety, or welfare of the child. In this situation, visitation will also be limited and the parenting plan will not require mutual decision-making or designation of a dispute resolution process.
